I don't think that 9b would be a problem for google considering how much they made so far, and how much android has contributed to bringing surveillance in everyone's pocket. If they were forced to fully opensource the code that would defeat their purpose and it wouldn't be allowed. Somewhat similar to the situation with Intel ME, though Intel managed to get away with it easily because of the original license.

A programming language or runtime is hardly something that can be stolen, particularly since it was publicly available and there are free oss implementations of it.

The use of Java without license is considered stealing.

Millions of Java developers were using Java without a license along with companies that use the finished product. Sun Microsystems never took action and in fact encouraged use, the only thing they weren't keen on was the possibility of the same developers taking control of the language design and creating variants, somewhat like French language police. It's ridiculous.
