Yeah, I think the separation is in "ethnically jewish" vs "culturally jewish." He's biologically "of the tribe of Judah," but he wasn't part of what the the temple law system grew into (which actually translates pretty clearly to their modern litigious culture). He was a jew, but he didn't act like one because he was perfect and without sin.
