If we're going to have hate crimes then sure I guess.
All violent crimes by their very definition are hateful. The notion that we both respect free speech yet levy additional punishment for one's thoughts or state of mind is absurd.

How many people are being punished/jailed because of fake hate crime claims?
It's just like when women get men jailed (including their lives destroyed) because they regret having sex with them.
Fake claims should all be punished.
