You are wrong. The FAA’s sole purpose for existence is to create and enforce regulation on the airline industry. If they couldn’t enforce regulation without legislation, then there would be absolutely no reason for the FAA to exist, it would just be done by congress

Every single executive agency is is bound by rule making processes that forbid those agencies from making their own laws and imposing them upon the people without the consent and oversight of Congress.
