I don't know why anyone expects it to. They literally can't be sued and they're funded by DARPA. They could sell nothing but rat poison shaped like cartoon characters in a brightly colored box and they still wouldn't go out of business.

If they comitted fraud during the clinical trials then they absolutely can be sued. Fraud vitiates the EUA liability.

In theory that's how it's supposed to work. In reality they are above the law. Judges work for a system in which these drug companies define the truth.
