They do and SCOTUS should uphold that separation of powers. Think of Trump trying to get $5B for the wall. Biden continuing to push this vote buying scheme to the SCOTUS looks like a desperation move to me. If they deny him, he uses it as propaganda that SCOTUS is politically corrupt, catering to MAGA. If they relent, separation of powers takes a big hit and he gains votes from many of those who benefit. He wins something either way.
