Maybe. I'm not sure how much is OSHA usurping congressional authority (recent EPA SCOTUS ruling) and how much Congress has authorized by law.
Anything beyond what they're already doing unless it fits in with whatever they were narrowly defined and created for by Congress should fall afoul of the EPA ruling.
