I was thinking recently, because of the frequency and severity of the "because I feel like it" method of governance in style lately, and because it takes citizens years and thousands of dollars to undo even blatantly unenforceable edicts, there should be enacted a legal penalty for an executive acting in bad faith; e.g. with reckless disregard or willful blindness to the limits of the office or scope of agency, or simply malice aforethought.

Right now there is no penalty for just making something up and sending public servant goons out to enforce it. It is time for a more significant penalty for wielding the power of government in bad faith than just saying "whoops".

While I agree with you - and I think most people here would, too - such a penalty would need to be created and enacted by the very same legislative bodies that act in bad faith. How likely is that?

Agreed. However, once they eliminate all legal means of remedy they will not like the alternative, but will have earned every bit of it.
