They would have to make their move before November 2022 as it requires a majority in both houses to confirm the appointment. The only way they could get a majority in the Senate now would be to have a GOP traitor to vote with them as Kamala represents the 51 st vote. If she is resigned then the vacancy negates the Democrats majority.
