Let's talk this through. says:

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

Nowhere in there does it say that a citizen has the right to aid and abet a felony.

Sandy can spout all she wants to about how bad the Orange Man is, but Homan is well within law to ask the US Attorney General whether she broke the law.

I think if the 1st amendment can be restricted, so can the others. The act of giving advice or instruction to do something could not be considered potentially criminal in itself.

Matt Hoover's case comes to mind.

It's not a restriction on the first. The amendment restricts what Congress can do.
