Fox News is reporting sources as saying that these videotapes were handed over to the FBI soon after Jan. 6th. If true, the Justice Department did have the evidence and failed to turn it over to the defense as constitutionally required.

They did the same thing in the Rittenhouse trial. Remember? They were discovered to have had a plane overhead recording the events in HD and didn't provide the footage to the defense.

This is an automatic mistrial no?

I think it is harder on the defense that some accepted plea deals thus admitting guilt, but I did hear an attorney explain that even that could be thrown out as the plea deal was made without this evidence being presented to the defendant. Hopefully all are released asap.
