Seems pretty clear it was deleted and recovered from a raid 10 drive. They simply didn't delete all copies. Now they claim it wasn't deleted because not all copies were deleted even though there was an attempt to delete it and they failed to do so. Technically correct, that it wasn't deleted. Technically correct, they tried and failed.
