That's an interesting question. I'd say if the missile is fired from a ship (by someone on the ship) then they're a legitimate sailor.

They remain combatants, even if this insulated. This feels like a throw back to the treatment of snipers or artillerymen in enemy hands.
They technically don't wear uniforms
They do until proven otherwise (you have to capture them).
If your scenario is enacted, the solution that the military will use will be to basically build Skynet.
Laws are just selectively enforced bullshit. Haven't you figured that out by now?
