I can't say they are awake, but they have always been a good resource to all sides that fight government & police overreach. I only say this because they have been able to help a legitimate amount of Nationalists & literal White Supremacists fight their legal battles.
I generally don't care for them because of the disproportionate number of lgbt rights they see fit to champion.
Do you have specific examples, or is that just your perception?
Since I am just some 'random' bloke on the internet, you might not take my word for it, but there is an ongoing case, that just happened, that I am very close to, that the ACLU is helping with (though you will never see it reported as such).
I apologize for the vague answer, but for the safety of those involved, I can not get any more specific than that at this time.
