Technically can't be pardoned unless successfully prosecuted. There's also no constitutional basis to provide people unlimited judicial protection.

Keep in mind, that's their opinion and it conflicts with those who wrote it. SCOTUS corruption or just plain old misinterpretation is nothing new. Contrary to popular perception, SCOTUS has never had the last voice in constitutional law. That last voice always remains with We The People.
