Biden can pardon them at anytime. they do not need to be charged. If they are pardoned, charges cannot be brought for them in the future. That is until they can't resist committing another crime. Rules for thee but not for me.
Wow, did not know that. I was sure that they had to be prosecuted with at least one felony (felonies....) before a pardon. Otherwise if there is no prosecution of a crime yet in place, what does the president give a pardon for? You just can't pardon in perpetuity for a crime you may have committed.
