Sussmann wanted to testify, BUT he doesn’t want prosecution to be able to question him about pretrial negotiations.

He filed a sealed motion yesterday at lunch to preclude prosecution from going there. Prosecution said they’d have a reply by 6pm (yesterday).

Prosecution, apparently, either did not respond OR did not agree.

There’s SOMETHING in those pretrial negotiations that Sussmann DOES NOT want brought up in court.

Wonder what it may be?

This entire episode shows Sussmann knows he is losing, badly, and wanted to Hail Mary himself onto the stand.

He’s facing five years in Federal lockup, losing the case on the evidence, he might as well try to talk his way out of it, right?

Whatever is in the pretrial negotiations is bad enough that he won’t even try now for fear of Durham bringing it up.

I’m thinking he proffered a deal to Durham.

And Durham replied, “No deals.”

Yes agreed. Those docs remain sealed for a reason. And the defense intention was to limit questions to Sussmann.

I agree I think Durham's got a deal with Sussmann and this trial was in part to get the evidence into the public square.
