That's how it is supposed to work. The Judicial Branch can override both the Legislative and Executive Branches. Executive Branch can nominate folks to be appointed to the Judicial Branch as a check and balance against that power. The Legislative Branch has to majority vote to confirm the Executive Branch's nomination to the Judicial Branch as a check and balance against the Executive and Judicial Branches.
