The PRESIDENTIAL TRANSITION ENHANCEMENT ACT OF 2019

According to this legislation, which was passed by congress, President Trump retains control of the military until 60 days after the inauguration of a new President.

The full transition of power does not occur until March which reflects what is actually written in the US Constitution.

Hey OP, did you actually read the PTE Act of 2019? Nowhere in it does it state that the outgoing president has command of the military for 60 days after the inauguration of the incoming president.

I read this bill/law TWICE and saw nothing of the kind indicating what you claimed about Trump retaining control of the military for up to 2 months after inauguration of a new president.

The period described begins on the day of the general election and ends 60 days later. The term "inauguration" is in there, but it refers to election day, and not the inauguration of January 20. Sorry, but according to this act, Trump does not control the military.

I'm with OP on this one. The text clearly states 60 days after the inauguration. There is no reference to election day at all. It doesn't make sense to interpret "inauguration" as election day since there is no president-elect at that point.

Besides his interpretation doesn't even make sense. The legacy POTUS has always retained control over the Military through Jan 20th at noon, on on Inauguration day. There would be nothing new to that.

But this is different, legacy POTUS now retains control over the military for 60 days AFTER Inauguration.

Election and Inauguration do not mean the same thing in legal terms:

Inauguration: Formal induction into office. A formal beginning or introduction. The act of inaugurating or inducting into office with solemnity; ceremonial investiture with office.

Election: The act or process of electing someone to fill an office or position.

You have to read the entire section in context. The "inauguration" mentioned refers to the period beginning on election day (November 3 general election) and not the January inauguration.
