The Aftermath and Legal Proceedings

The Investigation: Investigators concluded that the women were actually the aggressors during the January 2016 altercation and assaulted a white female passenger, rather than being the victims of a racially motivated attack. No racial slurs were used against them.

Criminal Charges: The women were indicted by a grand jury on charges of third-degree assault and third-degree falsely reporting an incident.

Case Resolutions

Alexis Briggs: Reached a plea deal. The charges were dropped after she completed 100 hours of community service, paid fines, and remained free of new arrests

Ariel Agudio & Asha Burwell: They were tried and found guilty of falsely reporting an incident in 2017. Agudio subsequently appealed her conviction, which the courts heard.

University Action

Following the conclusion of the university’s internal student conduct process, the school took direct administrative action:

Ariel Agudio and Asha Burwell were permanently expelled from the University at Albany.

Alexis Briggs received a two-year suspension.
