Smart people would have made them safe and then charged tourists to use them.

Probably. Its apparently on private property and since this is the US everyone is terrified about the liability part.

Sadly rightfully so. There's always a kippa out there trying to sue someone into poverty. If you drive around any major city all you see is the last name stein, stone, berg, blatt talking about their million dollar settlement win. Granted some lawsuits are justified but not every one of them.
