Although in theory hate crimes can be committed by anyone, in practice they don't like prosecuting crimes committed by Muslims or other minorities as hate crimes. Basically, shouting "Allahu akbar!" encourages the judge to minimize the severity of the charges.

What would happen if the guy is charged with hate crime and is recognized mentally ill?

I'm not a lawyer, but sometimes people are found not guilty by reason of insanity. Merely being mentally ill may not be enough for a not guilty verdict though. Alex Fields is an example where someone with a mental illness was found guilty on hate crime charges.

If Jews are an oppressed class, they'll need extra legal protections. But if you give them extra legal consideration, that makes them a privileged class (confirming an antisemitic stereotype). And prosecuting a Muslim for an antisemitic hate crime also opens up its own can of worms. It must have been a tough decision for the judge.

Hate crime and political correction are Jewish inventions to censor the freedom of expression that is unlimited and thus hide its criminal nature and that its crimes against humanity are not exposed. They control a good part of justice but hey, you have to clean the house
