Strange
Although in theory hate crimes can be committed by anyone, in practice they don't like prosecuting crimes committed by Muslims or other minorities as hate crimes. Basically, shouting "Allahu akbar!" encourages the judge to minimize the severity of the charges.
What would happen if the guy is charged with hate crime and is recognized mentally ill?
Charges dropped?
I'm not a lawyer, but sometimes people are found not guilty by reason of insanity. Merely being mentally ill may not be enough for a not guilty verdict though. Alex Fields is an example where someone with a mental illness was found guilty on hate crime charges.
