the driver is 1099 contractor and should be able to go after him, hes supposed to have insurance that covers that and most do not.

excellent point. most 1099 employees have Errors and Omission insurance. Not sure if he's required to have or not, I'd imagine yes but what should be isn't the case typically nowadays.
