Interesting point. I hadn't considered it that way.
Here, you may copy/use as you wish my typical testimony that I give to legislative bodies:
"I will not convict anyone of any gun crime; I consider all gun laws void. Stop treading on my rights. Rights, by definition, are not subject to any type of state regulation.I will certainly not find anyone guilty of any of these outrageous laws that tread upon our rights to keep and bear arms. And I will not convict anyone of any crime until the state repeals all gun laws and I would urge my fellow citizens to do the same in exercising our jury nullification rights as citizens."
I have convinced about 20 people in my state who are potential jury duty folks to agree with the jury nullification of all crimes and about 100 to pledge to nullify in respect to just gun crimes. If 10% of pro-gunners took this position to use jury nullification as one tool in our toolbox, then defense attorneys might take notice.
After all, to pass legislation all it needs is 51% of the idiot legislators (who don't care about the constitution) to pass a law. But to convict a person via jury trial, only 8% is needed to effectively void the law (1 juror out of 12 refusing to convict). If every gun owner refused to convict due to the laws being wrong then no convictions would ever occur.
I have refused to convict a defendant when I served in a jury. 11 for, me against. I let it known why and the judge blasted me and I just told him too bad. The defense attny even looked miffed. That defendant ended up taking a deal that involved him pleading guilty to an infraction of some sort vs. convicted of a felony gun crime. Pretty sure I'm on a "do not call" list as I have not been called to jury duty since.
I'll have to keep this one in mind, I'll be saving it for future reference if you don't mind.
