his guitar really does not seem to like to stay in tune, he let me play it the other night and it was like, what a piece of shit

No, that too is an issue. It's often mostly in tune for the first half of a song, like he's tuning it between songs.

Is he tuning by ear?

we do tune it between songs, or at least before something we are going to record

Does he just tune to your guitar, use a tuner, or tune entirely by ear?
