States have a Constitutional Right to regulate themselves. The Federal Government can only insert themselves when the matter involves interactions between States. It's called State' rights, and it was what the Civil War was fought about. And, even though the South lost, the Constitution is still very clear on this matter.

But I wouldn't anticipate courts or lawyers would know, or care about any of this.

Show me where in the constitution it is written that murdering babies is a right.
