Certainly today jewish courts will tend to slant things away from us, but it's going to end up in jewish courts anyhow and at least with prenups we can have more of a say in the process.
It's worth mentioning that those laws and contracts were written in iron age Ireland long before any jews and while divorce was legally straightforward there were massive social consequences and loss of face for everyone involved. People didn't treat divorce casually. The purpose of marriage contracts was to ensure both parties knew their resonsibilities and lived up to them.
I think if the incidence of polygamy ( specifically having children with more than one person) is more than a couple of percentage points of the population, it will destroy the social stability of the monogamist civilization. Polygamy traits are hereditary. If you allow someone to reproduce 2x as much as everyone else (ie. divorce and marry a trophy wife, have more kids with her) then the next generation will have 2x as many polygamists than the last.
You just can’t allow males to reproduce with more than one woman with any frequency and hope to maintain a monogamist society. And males will always tend toward having more females if they can get them, unless they get shut down by other males.

Well... if the motivation is more children, then why not have more children with wife 1? If she's refusing to bear him children then I'd say that's legitimate grounds for divorce.
Also, aren't most divorces initiated by women? Men typically have everything to lose in a divorce unless it's absolutely necessary.

I think that true. If wife number 1 refuses to have children and there are no children, then I think you can avoid the downstream population wide effects of polygamy (i.e. Everybody acting like muslims, and no Im not kidding)

Possibly. How many of them are actually triggered by a male infidelity? I would want to verify that before I hung my hat on it.
I think traditionally the male initiated divorce by skipping town never to be heard from again. But now they can track people down and make them pay. And with child support and many women collecting on welfare programs and having jobs, being divorced is much more doable for women. But this arrangement is basically a polygamous one, and if the guy has enough money to support the old wife and kids while pursuing a new wife and kids, I think this is really a case of patriarchal polygamy, aka—muzzies. I just worry that we will be turning into either muslims or africans, in a functional way.
