It could easily be argued he was still in fear of his life (possible accomplices around the corner, etc), and he retreated to a safe place before calling 911. Its a fairly regular thing for self defenders to flee the area for that reason, and never getting charged. Of course it all hinges on calling the police as soon as you can.
