The DeLand Police department said the male victim experienced a hard landing as a result of the malfunctioning parachute.

The number of things that have to go wrong in order for this to happen is high. Someone is going to jail for negligence.

No one is going to jail, a malfunction could be any number of things that happen when the chute deploys. More than likely he had a bubble that he thought he could work through and instead of going to his reserve. It happened to my instructor, put him, in the hospital for a few months.
