Kroger is already in trouble for this. There is a trial going on:

That's in relation to their proposed merger with Albertsons.
They should have done this "investigation" when Kroger implemented those stupid-ass loyalty cards. Prices went up (as evidenced by their sale flyers) even though they said prices did not.
They are claiming that allowing the merger (creation of a massive monopoly) will somehow LOWER prices. I don't think that has ever happened in history.
Yes, they are claiming that. But they claimed it did the same when they introduced loyalty cards, and it did not.
