They claim that the train conductor was negligent, I on the other hand think the guy on the bike that in total maybe was around 320 lbs max is a fucking moron and should be more concerned about a light rail train that could way a few tons.

This reeks of someone just trying to win the 'nigger lottery' by suing the state/RTD because their family member was a fucking moron. I am willing to bet that this is thrown out after video shows up with him ignoring signals and trying to pass through the crossing without paying attention. This has happened at least 1-2 times a year (for walkers or bikers) for the last 4 years at least.
