So who claims expertise to decide?

It is not about claiming expertise, it is about "intent". In order for a security expert to perform any Penetration (Pen) testing, there has to be a written agreement signed by the client (target) and the Pen tester stating what will be done and where it will be done in order for the tester actions to not be illegal. have been prosecuted by companies they embarrassed by identifying and informing them of flaws without a written agreement. If you expose a flaw that embarrasses a company, you might still get jammed up having to prove your intent what innocent.

This is actually not as bad as it sounds. Third parties who test the security of a system just for the fun of it generally could be prosecuted if they let the system owner know of the flaw they exploited. A white hat hacker is just an enthusiast or a commercial security expert who looks for security flaw without the intent of damage or theft.
