A prosecutor can charge anyone with anything at anytime. Their responsibility is to charge only those where there is sufficient evidence to convict. There is a saying that a prosecutor could indict a ham sandwich. In China, there is no jury of your peers so if you are charged, you are pretty much fucked. Justice for the common man is an illusion.
