Authentication faces the same exact problem, right now. You can photoshop an image and write an affidavit authenticating it. Is it illegal? Yes. Do people get away with it? Yes. People win with fake emails in court ALL THE TIME. I have assisted many people in teaching them how to prove whether an email is fake, or not.
