Wait - the government of Spain demands that sunken treasure that originally belonged to them isn't salvage but instead still belongs to them. But if it was owned by a private individual then it's properly salvage and belongs to the people who pick it up. Problem solved!

Unless the Ship/ contents was sailing under Spanish Govt/ Royalty Authority ... which was fairly common back then for private individuals etc ..
