It's the difference between saying "go kill yourself" the command, and "I think you should go kill yourself" the personal opinion. Where one can be a 5th degree verbal assault, and the latter is a statement of person opinion. Which we are all entitled to under the 1st amendment.

This only works when "fighting words" are in place as well.

Depends on the intent and how close you are & mental status of the recipient. If you know someone who is teetering on the edge and you try to convince them to end it, its different than telling a stranger.

How does putting in 'I think' change the legality? It's not like saying suicide should be an option.

If you are suicidal, and I say "go kill yourself" then you go do it, there is no reasonable deniability that you did it because I told you to go do it.

Now if you told me you are suicidal, and I said " wow I think id kill myself if I were in your shoes" that's just being insensitive to the situation. It's not unlawful to be honest. But I surely didnt tell you to do anything.

If you found you woman having an affair, and I said "go kill the both of them!" And you do. I'd be an accomplice, but if I were to say "man in my opinion, they deserve to be shot" how am I supposed to know you are going to just take my opinion so seriously?
