So residency and right to possession changes depending on who is in the home at any given moment? Ridiculous.

"If you had been home during the break-in it would have been a robbery charge. Since you haven't been here for two weeks it's a civil matter and you're now trespassing."

That was my thought. I own the property, we have no agreement for you to use the property. It should not matter in that case. You are trespassing and can be removed by force.
