“Thompson reached into the vehicle and pressed brake with his right foot, keeping his other foot on the floor,” the plaintiff summary says. “He pressed the start button. When the vehicle did not start, he took his foot off the brake and depressed the clutch pedal. He again hit the start button. This time the Jeep started. He removed his foot from the clutch, still standing outside the vehicle. The vehicle lurched forward.”

Thompson told authorities that he did not have a driver’s license, records show, and he did not know how to operate vehicles with manual transmissions. The 19-year-old also said he’d never taken a driver education class or been taught how to use stick shift vehicles.

So let's see:

  • Dealer hires tech who obviously doesn't know how to drive stickshift, and doesn't even know how to DRIVE in general.
  • Tech does something stupid with vehicle and kills another person.
  • It's the vehicle owner's fault

What?

I'd turn right around and sue the dealer for obvious negligence in safety and hiring practices that resulted in the destruction of his car.

This is the only correct answer, except that I would demand my oil change in my list of damages.

And then do your own oil changes.

We have a legal system, not a justice system. Huge difference. There is a group of people that steered it that way. No, I'm not talking about lawyers, it's a bit more specific.

And I have in the past. Sometimes it might be better for the reader to use his brain a bit and come to their own conclusions.

Judenrats love the legal profession because it gives them a chance to shoot their mouths off, but none of them really understands the concept of justice.

So someone didn't know how a manual transmission worked. The fact he tried to start a manual with the brake pressed in and not the clutch and then also let off the clutch after it was running while still in gear.

The guy didn't even know how to drive, according to the article.

This is the most jewish article I've read this year, so far.

OSHA violation.. specifically having employees operate equipment without adequate training and no familiarity or demonstrated competence... the dealership should be forcibly closed.

Those lawyers should be shot

Actually it kind of makes sense after you read it in a way.

While Diaz-Navarro is said to have “no active negligence,” records say he has offered $100,000 in policy limits as he agrees he “is liable for damages under the owner’s liability statute.” But, as the court ruled he is entitled to indemnification, the dealership and Thompson would be held liable for any awarded damages and attorney fees in this case.

Insurance. His car was involved in the accident. That's how it goes I guess. I don't agree with it entirely but it sounds like he isn't getting sued for the 15 million. The vehicle owner isn't. The owner even agreed to the liability statute.

Why can't an employee sue their employer for negligence? Employers should be held responsible for ensuring their employees are adequately trained and competent for the tasks they are required to perform.
