They're not legally guns; the lower needs machining to complete it which counts as building one from scratch for personal use. Building your own gun from scratch has always been legal; you just can't do it specifically to sell it without an FFL.

Also you can sell them, but need some cool off time (no one knows the formula) and then you have to serialize. But it’s easier to ever sell anything and never be in the radar.
