They still pinned it on Lee Harvey because he was in the USSR and set up as a patsy which is why a lower ranking mobster named Ruby did the hit on camera to wrap it up. Ruby knew he was dying of stage 5 cancer so he did it to secure his family with a nice financial package. Ruby then died in prison shortly after and Lee Harvey did as well.
