In most states, yes. Now a Luty SMG like the one pictured? No, but only because of the '86 Hughes Amendment to the NFA which prohibits unregistered/new production machine guns after the enacted date.

Even if the '86 ban hadn't taken place, home made MGs would still be a legal impracticality because of the '34 NFA required tax stamp, which inherently requires a serial number; why build a janky garage gun if you're just going to serialize and register it anyway?

You could build a Luty legally, but you'd have to modify the trigger group or bolt for semi automatic function. There is nothing illegal about having a semi auto open bolt design.

Yes, or you could do full auto dealer sample if you have your SOT and run a steady business. Still, why? In the modified semi format, the ATF can potentially be real bastards to someone and interpret the law as "readily convertible". For SOTs, they're novelty builds. I think Brandon Herrera is planning to build one.
