This whole hate crime thing has always been a joke to me. There are already plenty of laws to cover a criminal act. No one should get more punishment because they made a racist slur or whatever when committing a crime. Personally, I could care if someone wants to spout racist, sexist, homophobic, whatever stuff ... that's their right under our freedom of speech. It only becomes a serious problem if they act upon it criminally. And even then, they've committed a crime, prosecute that, not a bunch of PC mumbo jumbo.
It's Thoughtcrime, plain and simple.
Here's another vein of thought: homicide vs. murder - the latter carries greater penalties primarily due to evidence of the perp's intentions or thoughts.
They have far too many ways to weasel anyone out of a crime through the different categories of everything. I think we should outlaw plea deals altogether. It pisses me off when someone kills someone and it gets lowered to some misdemeanor thing because the prosecutors are too damn lazy to do their jobs. Justice is not served.
As for the other:
"I may disagree with what you have to say, but I shall defend, to the death, your right to say it." - Voltaire
Such things used to be taught when it comes to free expression ... no, apparently, not so much.
Yes, I think district attorney's or state's prosecution has too much discretion in what charges and sentences to pursue.
