Yeah, we as the audience know everything from all sides... in the trial they didn't have any evidence that would stand up for Old Caprica happenings

Under normal circumstances, he did and deserves death. However, under BSG circumstances....no. A lot of the leadership on that vessel did some really questionable and shitty things (to say nothing of the last five). So many of them are forgiven and turned free again. This guy though gets the short end. Also, it all started chasing a fine piece of ass. He does so many terrible things chasing that ass that he hopes he is a cylon to redeem himself. Moral of the story: don't stick your dick in crazy kids.

Yeah they address that in the trial. I don't like how they made him a drunk womanizer on New Caprica... Seemed too 2-dimensional
