I agree with you regarding the unfettered right to free speech. When ever there is a contract you agree to, you may be signing away those rights though. First of all, I am not defending Twitter, Facebook, or any other similar organization. They have taken their 'privilege' to operate to nefarious ends, which urgently needs to be dealt with. However, equality under the law states, even in the US Constitution that agreed upon contracts override Constitutional rights. If this was not so, every enlisted military person would not be bound to the Uniform Code of Military Justice. This is, in essence, the law of the high seas; Admiralty Law. Each enlisted military person has signed a contract forfeiting their rights under the US Constitution. This however, is within certain limits. The same can be said of the contract signed by every individual subscribing to Twitter, Facebook, and similar. I believe the 'certain limits' has well been exceeded. For every contract agreed to, there are limits to what can be agreed to. Use your imagination to possibility of the perverse and wicked terms and conditions of a contract. They simply are not permitted in a natural society. How many people actually read the "Agreement" (ergo, 'Contract') for using Twitter, Facebook, and other companies? There's no way I am aware of to negotiate the "Agreement". It is always "Their way or the highway".
I think the Terms and Conditions of the Agreement has to be adjudicated and settled. It has reached the level of signing (Agreeing) to something under duress. In other words, your Rights have been eliminated for the sake of using a product. Sometimes the product has become so dominate that it is the venue of choice. I have always believed that free speech should always be without conditions as long as it is not a direct threat to your body and limb, property, nor to your livelihood and family.
