It's arguably against US law, and allowing it brought down 8chan and broke Voat. It serves no purpose other than for shills.

Supposedly. The official narrative is the shooter posted it there. What we really know is it was posted by someone and they used that as an excuse to bring 8chan down. I'm not sure how quickly it was removed, but no amount speed in removing bad content is enough if they are looking to take you down.
The problem with a policy of banning things like this is some examples, like this one, are really easy to identify. Some are more grey area. Some might be deleted faster if the admins don't like you or impute some bad motive. But yeah, there needs to be a line somewhere, but I wouldn't jump to the conclusion that following the rules can save your ass.
They have plans and stories prepared to bring down any site they choose. 8chan was hit because it was convenient and not controlled. How many know it was posted on kikebook’s instaham before posted on 8chan?
Something can be illegal but constitutional at the same time.

It shouldn't be against US law. Speech is speech. What kind of speech do you think George Washinton, Thomas Jefferson, and Samuel Adams were trying to protect? The kind they would have been in trouble for if they had lost the war.
