If it gets ruled a mistrial the media would paint it as Rittenhouse getting off on a technicality.

He'll probably wait and hope for a innocent verdict from the jury at which time he doesn't need to. Or if a guilty verdict he can do a directed verdict of innocent or then claim mistrial.
