It's always fun to watch the pilpul around WP. It's legal to use for smoke, illegal to use against people. There are plenty of other ways to make smoke.

The US army used wp against enemy troops as well. Supposedly it wasn't to be used against civilians. But I think it was used in incendiary bombs dropped on Japanese cities. As long as you win everything is legal.
