I applied for the following job which stated this criteria:

'About you

You’ll be flexible to work at short notice and ready to join us over the next few weeks. The great news is that you’ll be gaining loads of experience working in different services or locations. But we do need you to be a real people person! You may already work with vulnerable adults or have done so in the past, however it’s not a deal-breaker if you haven’t. To be brilliant, we do need you to have a caring nature, brilliant customer service skills, and the passion to make a difference!'

In the application process they said 'We are a positive about disabled people employer, are you applying under the guaranteed interview for disabled people scheme?'

I selected yes because I am disabled.

I still didn't get an interview. When I asked them why they said because I had no experience of looking after vulnerable people, and everyone that was shortlisted for an interview did have this ... But the job advert said that 'wasnt a deal breaker'?

And in fact I do have experience of helping vulnerable people, but the job advert not only said it wasn't mandatory, it also didn't specify I had to tell them when applying. If they had given me an interview and asked me then I would have been able to tell them about this.

I spoke to employment solicitors on the phone and they didn't dispute that I had been discriminated against as they did break disability employment law, but it wouldn't be enough money for them to help me on no win no fee. They advised me that because it was a zero hour contract job, I could seek 6 months worth of wages for how much I had planned to be able to work for, so it was £9.31 ph multiplied by 40 multiplied by 26, which was about £9700, plus I could have done more than 40 hours sometimes so £10,000.

First it goes through ACAS as a mediator and if that doesn't work then an employment tribunal.

Shit like this is why no one wants to hire anyone else, or why you need to pay to have a team of lawyers on standby when you decide to do so.

The money that should be going to the employer (to grow their business) or the worker, is being sent to a fucking lawyer. A lawyer the contributes exactly ZERO in terms of economic productivity.

And you wonder why all the jobs are being sent overseas to third world shitholes.

Yep. A lot of people can't seem to make that connection. Similarly why third world shithole residents are being imported to do jobs.

Or they could have given me my guaranteed interview and still not given me the job?

The disability employment scheme is opt in, employers don't have to do it. If they choose to do it, they advertise that they are a 'positive about disability' employer which means guaranteed interview (not job) for disabled people that meet the job criteria.

On the other hand its not just suing them for not giving me an interview, actually bother to read the job description.

They wrote it wasn't a deal breaker if you haven't worked with vulnerable adults in the past, but they refused to interview me because I hadn't. That alone is illegal for false advertising.

If they're getting some kick-backs from the incentive, then I'd advise notifying the government department responsible.
