On the heels of the rollback of the Biden Administration’s “zero-tolerance” policy for minor clerical errors by gun dealers, federal legislation introduced in the U.S. Senate last week by a longtime gun-ban proponent would compel the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) to harass and badger lawful Federal Firearms License (FFL) holders.
During the Biden years, the punitive policy implemented by the ATF and DOJ at Biden’s direction, ran nearly 200 licensed gun sellers out of business for simple clerical errors to lower the number of FFLs and, thereby, make it more difficult for Americans to purchase firearms.
Of course, Democrats in the U.S. House and Senate weren’t happy with the rollback. And on July 1, Sen. Ed Markey, D-Massachusetts, introduced a bill to put undue pressure back on FFL holders under the guise of targeting “irresponsible” gun dealers.
The measure, called the Keeping Gun Dealers Honest Act, would, among other things, increase the allowable number of ATF inspections of firearms dealers from one to three per year, increase the number of ATF inspectors and strengthen criminal penalties for dealers who knowingly violate the law by committing serious record-keeping offenses that aid gun trafficking. It would also permit ATF discretion in issuing firearm dealer licenses and provide the ATF with more flexibility in determining sanctions to ensure the punishment fits the crime.
