Technically, no. If they don't have a working knowledge of English they can't apply to live here. Not speaking English is not what makes them illegals. Sneaking over the border makes them illegals. By default, anyone who enters the country illegally has violated the law and is an illegal alien.
My great-grandparents spoke barely any English when they came over. They had to learn to speak it well enough to pass the citizenship test before they could even apply to take the test. Lucky for me they passed.
My point is that their not comprehending any English is a serious clue that they're illegal. Speaking a little bit is understandable. Many speak none at all. Those are easy to spot and report.

Yes. If you meet someone and they speak no English at all (and are furtive about it) they're at least worth looking into.
